Following deliberations by the Taiwan High Court, Kinmen Branch of Fujian High Court, and Intellectual Property and Commercial Court on amendments to increase fee standards for civil litigation and non-contentious proceedings, and subsequent approval by the Judicial Yuan, the Judicial Yuan issued amendments on December 30, 2024, to the “Standards for Increased Collection of Civil Litigation and Compulsory Execution Fees by Taiwan High Court,” “Standards for Increased Collection of Civil Litigation and Compulsory Execution Fees by Kinmen Branch of Fujian High Court,” and “Standards for Increased Collection of Civil Litigation and Compulsory Execution Fees by Intellectual Property and Commercial Court,” effective from January 1, 2025.

Key amendments include:

1. Amendment of Regulation Titles: To accommodate the addition of provisions for increased non-contentious proceedings fees, the current titles have been amended to “Standards for Increased Collection of Civil Litigation, Non-Contentious Proceedings, and Compulsory Execution Fees by Taiwan High Court,” “Standards for Increased Collection of Civil Litigation, Non-Contentious Proceedings, and Compulsory Execution Fees by Kinmen Branch of Fujian High Court,” and “Standards for Increased Collection of Civil Litigation, Non-Contentious Proceedings, and Compulsory Execution Fees by Intellectual Property and Commercial Court.”

2. Increased Civil Litigation Court Fee Standards: For property-related lawsuits or appeals filed under Articles 77-13 and 77-16 of the Civil Procedure Act, litigation amounts of NT$100,000 or less will incur an additional 50% surcharge on the original fee; amounts exceeding NT$100,000 up to NT$10,000,000 will be adjusted to an additional 30% surcharge; amounts exceeding NT$10,000,000 will maintain the original 10% surcharge (see Appendix 1). New provisions add a 50% surcharge on original fees for non-property-related lawsuits or appeals under Articles 77-14 and 77-16 of the Civil Procedure Act. Additionally, new provisions impose a 50% surcharge on original fees for retrial applications or appeal cases under Article 77-17, Paragraph 2, and Article 77-18 of the Civil Procedure Act (see Appendix 2).

3. Increased Non-Contentious Proceedings Fees: Non-contentious proceedings fees have remained unchanged since the Non-Contentious Proceedings Act was amended and promulgated on February 5, 2005. New provisions impose a 50% surcharge on original fees for non-contentious proceedings under Articles 13, 14 Paragraph 1, 15, and 17 of the Non-Contentious Proceedings Act (see Appendix 3).
