The Legislative Yuan passed the “Artificial Intelligence Basic Act” on its third reading on December 23, 2025. The Act clearly stipulates that when the government promotes the research, development, and application of artificial intelligence (AI), it must strictly adhere to seven core principles: 1. Sustainable development and well-being; 2. Human agency; 3. Privacy protection and data governance; 4. Cybersecurity and safety; 5. Transparency and explainability; 6. Fairness and non-discrimination; 7. Accountability.
Given the extremely broad scope of AI research and applications, each government agency should conduct proper resource planning based on the nature of its duties and actively promote research, applications, and infrastructure development in accordance with relevant laws. At the same time, the Act explicitly mandates that the government must ensure the use of AI does not cause substantial harm to people’s lives, bodies, freedom, property, social order, national security, or the ecological environment. It must also strictly prevent derived issues such as conflicts of interest, bias, discrimination, false advertising, misleading information, or forgery.
Furthermore, to align domestic AI development with international standards, the government may collaborate with the private sector to promote innovative applications and actively engage in international exchanges. Regarding the protection of citizens’ rights, the competent authority for personal data protection should assist relevant departments in establishing system designs that prevent the excessive collection of personal data. When government agencies adopt and use AI, they are legally required to conduct prior risk assessments and take corresponding preventive measures to establish unified usage norms and internal control mechanisms. After the law officially takes effect in the future, the competent authorities should also comprehensively review and adjust their current responsibilities and related regulations, and further formulate specific operational guidelines to ensure the effective promotion and sound development of AI policies.
