The Ministry of Finance recently amended the “Regulations Governing Reduction and Exemption of Income Tax for Foreign Special Professionals” (hereinafter “The Regulations”) to foster a more talent-friendly environment. In addition to easing certain work permit exemption requirements, the amendments introduce several new provisions regarding the continuity of tax incentives. Key highlights are as follows: 

Foreign special professionals who have obtained an associate degree or higher from a higher education institution in Taiwan will have their period of study (including legally extended residency) excluded from the residency day calculations for income tax purposes. This prevents foreign students from inadvertently becoming tax residents due to their studies, thereby facilitating their transition to professional employment in Taiwan. 

For first-time arrivals who have applied for a “special professional work permit or Employment Gold Card,” the amendments provide more flexibility regarding administrative delays. If an applicant was initially issued a general work permit due to lengthy processing times, they may now be considered to have met the foreign special professional criteria from the date they began professional work under that general permit. Consequently, they may apply for tax incentives starting from that date, provided they meet the relevant eligibility requirements. 

During the five-year tax incentive period, foreign special professionals may continue to enjoy income tax reductions even if they change employers or jobs, provided they continue to meet the necessary eligibility requirements for the remainder of the period. 

Overall, these amendments offer more favorable tax measures to foreign special professionals, aimed at enhancing Taiwan’s competitiveness in attracting global talent. Foreign special professionals and their employers are advised to carefully monitor residency day calculations, work permit procedures, and tax incentive application deadlines to ensure timely and effective tax planning.
