In late August 2025, the Executive Yuan passed the “Artificial Intelligence Basic Act Draft,” which aims to establish fundamental principles for AI research, development, application, and governance, promote technological innovation and international alignment, and position Taiwan as an “AI Island.” The draft focuses on the protection of intellectual property rights and personal data to ensure a sound environment for AI development. The rapid advancement of AI technology has brought extensive economic and social benefits to industries and social activities, but it is also accompanied by potential risks. Article 3 of the draft proposes basic principles that balance industrial development with risk management to enhance national competitiveness.

The draft defines artificial intelligence as an autonomous system that achieves specific goals through machine learning and algorithms. Additionally, Article 14 emphasizes that data is a critical element in AI development, and the government should establish mechanisms for data openness, sharing, and reuse to ensure high-quality data supports AI development while maintaining the nation’s diverse cultural values and intellectual property rights. To protect personal privacy, Article 13 stipulates that all personal data collection and use must be strictly controlled to avoid unnecessary data collection.

Furthermore, to enhance AI safety, the draft clearly defines responsibility attribution for high-risk applications and establishes relief and insurance mechanisms. Moreover, Article 12 addresses responding to occupational changes caused by AI development, requiring the government to provide employment counseling for the unemployed and ensure workers’ occupational safety and labor-management relations. Through these measures, the government hopes to promote AI technology development while safeguarding the rights and safety of all parties.
